What to do when a tree fallsNew Brunswick's Chapter 8.48 has a general rule against removing any tree of 6 inches DBH or more, but for an ordinary residential lot the operative test is a counting one. On a lot under twice the required minimum size, the permit obligation starts at five or more trees of 10 inches DBH or greater in a two-year period; on a larger lot, more than six. The City's own application form asks exactly those questions, which is the clearest sign of how it is applied.
The review fee is $100. Replacement is generous in scale — three 3-inch caliper trees for a 6 to 12 inch removal, rising to ten for a 30 to 36 inch tree — or $80 per caliper inch into the Tree Preservation Trust Fund. Dead, dying, diseased and damaged trees are exempt, as is any tree whose angle of growth makes it a hazard, and any tree causing structural damage to a building or foundation.
