Most Fanwood Lots Are Exempt — Because of Their Size

Fanwood's rule turns on lot size more than tree size. Section 184-106 requires a permit for any tree of 6 inches or more, but the exemption immediately after it releases tracts of a quarter-acre or less with a single-family home already on them. A large share of Fanwood's lots fall under that line, so most homeowners here need no permit at all.

On a bigger lot you may clear up to a quarter-acre for the residence and take up to 25% of the trees on the remaining ground before a replacement plan is triggered. Note that Fanwood measures diameter six inches off the ground rather than at the usual 4.5 feet, which makes its six-inch threshold stricter than it sounds. Dead, dying, diseased and hazardously leaning trees are exempt.

  • Tracts of a quarter-acre or less with a single-family home are exempt
  • Larger lots: clear up to a quarter-acre, plus 25% of the trees on the rest
  • Measured 6 inches off the ground, not at 4.5 feet — a stricter test than it appears
  • Exempt: dead, dying, diseased, or hazardously leaning trees
  • Fee where it applies: $50 application, plus $100 review for the first quarter-acre
