Most Fanwood Lots Are Exempt Because of Their Size
Fanwood’s rule turns on lot size more than tree size. Section 184-106 requires a permit for any tree of 6 inches or more, but the exemption immediately after it releases tracts of a quarter-acre or less with a single-family home already on them. A large share of Fanwood’s lots fall under that line, so most homeowners here need no permit at all.
On a bigger lot you may clear up to a quarter-acre for the residence and take up to 25% of the trees on the remaining ground before a replacement plan is triggered. Dead, dying, diseased and hazardously leaning trees are exempt.
- Tracts of a quarter-acre or less with a single-family home are exempt, unless in a proposed major subdivision
- Larger homestead lots: clear up to a quarter-acre for a residence, plus 25% of the trees on the rest
- Fees are set by § 184-42 of the Borough code; confirm the current figure with the Borough
- Exempt: dead, dying, diseased, or hazardously leaning trees
- The Board decides within 90 days; the Borough Engineer then issues the permit
