Scotch Plains Adopted a Tree Ordinance in 2025: It Is Not in the Published Code Yet
Scotch Plains used to be the local outlier: no tree ordinance at all. That changed in 2025, when the Township adopted a Tree Removal and Replacement ordinance under the NJDEP requirement that every Tier A municipality control tree removal to cut stormwater runoff. It brings a Tree Removal Application for street trees, a permit for development work, and replacement scaled by trunk size.
One thing to know before you search for it: the ordinance is not in the published Township code. The online code still runs to December 2024, so looking it up returns nothing and it is easy to conclude there is no rule. There is. What the ordinance does not spell out cleanly is the ordinary case: its application language is written around street trees and development rather than a backyard tree on a private lot, so for those we confirm the current requirement with the Township rather than guess from the text.
- A Tree Removal and Replacement ordinance was adopted in 2025 under NJDEP’s Tier A stormwater mandate; confirm the current text with the Township Clerk
- Street trees: a Tree Removal Application from 2.5 inches DBH, approved by the Township before anything comes down
- Development work (subdivision or site plan) needs a tree removal permit, filed alongside the Land Use Board application
- Replacement is scaled by trunk size, or $750 per non-replaced tree into the Township Tree Fund
- Non-residential applicants pay $25, $75 or $250 a tree, depending on how many they take in a calendar year
- Penalties run to $2,000 per tree, and your contractor must confirm the permit was issued before starting
- The ordinance is written around street trees and development, so for an ordinary backyard tree we confirm with the Township first
