Berkeley Heights has one of the stricter tree ordinances in the area, and the township recently revised it specifically to slow down large-scale removals, so the rules are tighter than they were even a couple of years ago.

In general, removing a tree 6 inches DBH or larger on private property (and 2 inches for flowering trees, 8 feet for evergreens, 2.5 inches for street trees) requires a permit from the township tree inspector, with an online application and replacements planted within four months and kept alive two years; trees in the public right-of-way trigger it at a lower size. Properties close to the river can also fall under state riparian-buffer rules, which is something we check before quoting rather than after.

The fee escalates with volume rather than a flat rate: $25 per tree for the first three in a calendar year, $75 each for trees four through ten, and $250 each beyond ten. Two-thirds of every fee collected goes to the township Tree Trust Fund. Removing without a permit carries a fine of up to $1,000 per tree, with each tree treated as a separate offense, plus replacement in the same category.

Most tree companies just tell you “yes, you need a permit” and hand you the town’s website. We’ll actually walk your property and tell you which of your trees cross the threshold, what replacements the ordinance is likely to require, and whether you’re inside the riverside buffer, before any work starts.

Filing the application is on you or your engineer; we don’t file permits. But you won’t get stopped halfway through the job. For storm-damaged or hazardous trees, we document the condition for both the township and your insurer, but the owner still owes the tree inspector written notice within five business days, and hazard trees still need a permit issued even though the fee and replacement are waived.
