Bernards Tightened Its Tree Rules in 2024: Here’s What Changed
Bernards rewrote this in June 2024. Under Section 16-3 of the Township Code you now need a permit to remove any non-street tree 6 inches DBH or larger anywhere in the township. The old exemption for lots of three acres or less is gone, so the rule reaches properties it did not touch before.
The permit itself is free. What it carries is a replacement obligation: one tree back for a 6 to 12.99 inch removal, rising to four for anything 33 inches or over, or $300 per tree into the Township Tree Fund where planting on site is not practical. Hazard trees are the exception: dead, dying, diseased, or confirmed a threat by a licensed tree expert, they come out with no fee and nothing owed back.
- Permit needed: any tree 6 inches DBH or more (2.5 inches for street trees)
- Applies to every lot; the under-three-acre exemption was removed in 2024
- Fee: none for the permit itself, but $300 per tree into the Tree Fund if the Township approves paying instead of planting
- Replacement: 1 to 4 trees by size, planted within 12 months and monitored two years, or $300 per tree if the Township approves
- Residents removing fewer than four trees an acre under 33 inches DBH in a rolling five years are exempt from replacement; request it in writing
- Hazard trees: no fee and no replacement, but the exemption must be claimed in writing
- Administered by Township Engineering, which refers each application to the Tree Protection Committee
