Bridgewater’s Tree Removal Ordinance: What Ordinance 21-11 Protects
Bridgewater regulates tree removal on private property under Ordinance 21-11, “Removal and Preservation of Trees,” administered by the Township Engineer. A Tree Removal Permit (written authorization from the Engineer) is required before removing regulated trees, except that a residential lot gets 3 trees a year in R-40/R-50, 2 in R-20 and 1 in R-10; even those still need an application and tracking fee filed with the Engineering Department. The part Bridgewater does differently: protected trees.
Most towns key everything to a single diameter. Bridgewater layers a set of “specimen” categories on top, and any tree meeting one of them is protected regardless of how ordinary it looks:
- A tree greater than 36 inches DBH
- A coniferous tree greater than 100 feet tall
- A tree of any size listed as rare, threatened or endangered by the NJ DEP
- A dogwood (Cornus florida) greater than 4 inches DBH
- A tree 100 or more years of age, as determined by an arborist
- A tree at least 75% the DBH of New Jersey’s largest recorded tree of its species, per NJ DEP
The fourth and fifth ones catch people.
A modest dogwood in the front yard, or a big old oak that has simply been there longer than the house, can be protected even though neither is unusually large, and once you’re past your zone’s yearly allowance, removing one without a permit is a violation. Replacement scales steeply. Where mitigation applies, Bridgewater’s replacement schedule rises with the size of the tree removed: brackets run 8–15 inches, 16–24, 25–36, and 37 inches and over, with the largest trees requiring many replacement trees each, and any that die within the first two growing seasons replaced again.
