03 Local Rules

Hillsborough Rewrote Its Tree Rules in December 2024

Hillsborough amended Article IX of its land use chapter in full in December 2024. A permit is required for any non-street tree of 6 inches DBH or more, or any street tree from 2.5 inches, and the application has to be filed before the tree comes down. The fee is $25, and dead trees carry no fee at all.

The exemption most homeowners rely on is the allowance for removing fewer than four trees an acre over a rolling five-year period. The Township's own FAQ still answers “do I need a permit?” with a flat yes, so the safe route is to apply and claim the exemption in writing rather than assume. There is also a ceiling worth knowing: no more than 20% of the trees on a residentially zoned lot may be removed even with replacement, counted cumulatively all the way back to November 2000.

  • Permit required from 6 inches DBH (2.5 inches for street trees)
  • Fee: $25 — no fee for dead trees
  • Exemption: fewer than four trees per acre over a rolling five-year period
  • Hard cap: 20% of the trees on a residential lot, counted cumulatively since 2000
  • Replacement: 1 to 4 trees, or $500 per tree in off-site mitigation
