03 Local Rules

Millstone Borough Currently Has Two Tree Rules Running at Once

Millstone Borough regulates tree removal under Section 30-106.1 of its development ordinance: a permit from the Environmental Commission for any tree over 6 inches DBH, with specimen and historic trees and anything in a riparian area going to the Planning Board instead. The fee is $15, and a permit cannot be refused for up to two trees per lot per calendar year provided they are not specimen trees and not on steep slopes or in wetlands.

In April 2024 the Borough adopted a second tree removal and replacement ordinance built on the state model, and nothing in it repeals the older section. The two carry different fees, different replacement schedules and different homeowner allowances. Until the Borough reconciles them we ask the Zoning Officer which application actually applies to your property rather than quoting a single figure that may be from the wrong rule.

  • Permit required above 6 inches DBH; specimen and historic trees go to the Planning Board
  • Up to two trees per lot per calendar year cannot be refused — but still need the permit
  • Fee: $15 under the older section, $10 under the 2024 ordinance
  • Exempt: dead or diseased hazard trees, and storm, flood or ice damage
  • Two ordinances are currently in force with conflicting figures — we confirm which applies
