Tree Removal Permits & Local Rules in Tewksbury
Tewksbury regulates tree removal under Chapter 16.20 of the Township Code (Tree Clearing and Removal), adopted in Ordinance 08-2014. The ordinance defines a regulated “tree” as any deciduous tree with a trunk diameter greater than 4 inches measured 4½ feet above the ground, or any coniferous tree with a trunk greater than 4 inches in diameter or taller than 6 feet.
Do you need a permit to remove a tree in Tewksbury?
A permit is required to remove a regulated tree unless the tree or property is exempt. The most common exemptions are:
- A residential lot of 1½ acres or less with a dwelling on it, except in the Local Historic Districts of Oldwick, Mountainville, and Pottersville, where the exemption does not apply
- In the Local Historic Districts you also need prior written approval from the Township Historic Preservation Commission, which can require a replacement landscaping plan
- Any tree dead or diseased from natural causes, or any other tree likely to endanger life or property
- Trees on or within 20 feet of a proposed home, or that home’s well, septic system or accessory structures
- Trees within 10 feet of the planned paved area of a residential driveway, where the driveway is aligned to save as many trees as possible
- Trees removed to install or maintain public utilities, on a nursery or orchard, or on a Farmland Assessment or Right to Farm property cleared for crops, pasture or a farm building
Permit fee and timeline
- $25 for an application covering 5 acres or less, plus $5 for each additional acre (no maximum)
- The Township Zoning Officer acts on a complete application within 10 business days
- Removing a non-exempt tree without a permit (or breaching a permit condition) means replanting trees whose combined diameter matches the one removed. Each tree is a separate violation, punishable by a fine of up to $2,000, up to 90 days of imprisonment or community service, or both
